ถ้าไม่มีอะไรเปลี่ยนแปลง “ฟิล์ม” รัฐภูมิ โตคงทรัพย์ อดีตดารา-นักร้องชื่อดัง ผู้หันมาเอาดีทางธุรกิจ-การเมือง น่าจะเข้ารับทราบข้อกล่าวหาต่อเจ้าหน้าที่ตำรวจในวันนี้ (6 ธ.ค.). หลังถูกออกหมายเรียกในข้อหา พยายามกรรโชกทรัพย์จาก “บอสปัน” ปัญจรัศม์ กนกรักษ์ธนพร แห่ง ดิไอคอนกรุ๊ป เป็นเงิน 20 ล้านบาท. แต่เมื่อวาน ก็มีข่าวที่ออกมาขโมยซีนล่วงหน้าไปก่อน นั่นคือการถอนตัวของ “ทนายสาคร ศิริชัย” ทนายความของ “ฟิล์ม” ในคดีนี้. ไม่รู้ว่าเป็นเทรนด์ของทนายความในคดีดังๆ ในช่วงนี้หรือเปล่า. เมื่อไม่กี่วันก่อน “ทนายปาเกียว” สายหยุด เพ็งบุญชู ก็เพิ่งประกาศถอนตัวจากการว่าความให้ “ทนายตั้ม” ษิทรา เบี้ยบังเกิด ในคดีฉ้อโกง “พี่อ้อย” 71 ล้าน ด้วยเหตุที่ว่า ความเห็นไม่ตรงกัน เรื่องแนวทางสู้คดี รับไม่ได้ที่จะให้กลับดำเป็นขาว กลับขาวเป็นดำ แถมยังเสี่ยงคุก เพราะทนายตั้มเอาเอกสารปลอมให้มาใส่ในสำนวนด้วย. เหตุฉะนี้ ทนายปาเกียว จึงต้องโบกมือลา.ส่วนเหตุผลที่ “ทนายสาคร” ขอถอนตัวจากการเป็นทนายความให้ “ฟิล์ม รัฐภูมิ” นั้นเจ้าตัวก็บอกว่า ไม่มีอะไรขัดแย้งกันเป็นการส่วนตัว แต่ไม่สะดวกใจที่จะทำคดีต่อ โดยได้แจ้งให้ “ฟิล์ม” ทราบตั้งแต่วันที่ 25 พฤศจิกายน แล้ว. แต่ก่อนจะถอนตัว ก็ได้ทำหน้าที่ทนายความไปลงบันทึกประจำวันไว้ ตั้งแต่วันที่ 22 พฤศจิกายน ว่าลูกความคือ “ฟิล์ม” รัฐภูมิ จะไม่หลบหนี และประสงค์จะสู้คดี.ย้อนไปที่คำพูดของ “ทนายสาคร” ที่บอกว่า ไม่สะดวกใจทำคดีต่อ ก็น่าสงสัยว่าไม่สะดวกใจเรื่องอะไร. ผู้รู้ทางกฎหมายให้ทรรศนะว่า หากดูกันตามพยานหลักฐานที่ปรากฏออกมาแล้ว คดีนี้ “ฟิล์ม” น่าจะรอดยาก. โดยเฉพาะคลิปเสียงที่ “ฟิล์ม” และ “เจ๊พัช” กฤษอนงค์ สุวรรณวงศ์” คุยกับ “บอสปัน” เรื่องจะพาไปออก“โหนกระแส” เพื่อสยบข่าวฉาว ของดิไอคอนกรุ๊ป แลกกับการได้เงิน 20 ล้านบาท โดยอ้างชื่อ “หนุ่ม” กรรชัย กำเนิดพลอย ด้วยนั้น. ถึงแม้บางทรรศนะของนักกฎหมาย อาจมองว่า ไม่ถึงขั้นพยายามกรรโชกทรัพย์ตามที่ผู้เสียหายกล่าวหา แต่อย่างน้อยๆ น่าจะไม่รอดข้อหา “พยายามฉ้อโกง”.ย้อนไปตอนที่คลิปหลุดออกมาใหม่ๆ “ฟิล์ม” พยายามแถ-ลงว่า นั่นไม่ใช่กรรโชกทรัพย์นะ เขาแค่“ขายงานพีอาร์” แล้วเขาก็ขายไม่ผ่าน. และคำว่า “ขายงานพีอาร์” นั่นแหละ จะย้อนกลับมามัดตัว เพราะ“หนุ่ม กรรชัย” ยืนยันว่า เขาไม่เกี่ยว ไม่รู้เรื่องด้วย แต่ถูกอ้างชื่อ. ความจริงก็เป็นที่รู้กันว่าใครไปออก “โหนกระแส” ไม่ต้องเสียตังค์สักบาท แถมได้ค่ารถกลับบ้านด้วย. และเรื่องนี้ “หนุ่ม กรรชัย” ได้แจ้งความดำเนินคดี“ฟิล์ม”ไว้แล้ว.สรุป ก็คือ “งานพีอาร์” ที่ “ฟิล์ม” เอาไปอ้างกับ “บอสปัน” เพื่อแลกกับเงิน 20 ล้านนั้น มันไม่มีอยู่จริง. เมื่อเอาของที่ไม่มีอยู่จริงไปเสนอขาย ถ้าขายสำเร็จ ได้เงินไป แต่ไม่มีของให้ ก็เข้าข่ายฉ้อโกง แต่เมื่อขายไม่สำเร็จ ก็เลยเป็น“พยายามฉ้อโกง” อัตราโทษจำคุกไม่เกิน 2 ปี.นี่คือเบาะๆ ที่อดีตพระเอกดังจะต้องเจอ. แต่ก็ยังไม่รู้ว่า ทางตำรวจมีพยานหลักฐานเด็ดที่จะมัดตัวในข้อหา “พยายามกรรโชก” อีกหรือไม่ ต้องติดตาม.
